Please read these Terms of Service ("Terms") carefully before using Hugo's Signals ("the Service", "the Platform", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Hugo's Signals is an AI-powered cryptocurrency market analysis platform that provides:

• AI-generated trading signals (BUY, SELL, HOLD) with confidence levels and reasoning
• Technical indicator analysis for cryptocurrency assets
• Signal notifications via email and/or Telegram (paid plans)
• Historical signal accuracy tracking and performance data
• Optional automated trade execution through user-provided exchange API connections (Premium plan only)

The Service analyses publicly available market data using artificial intelligence models and technical indicators. The output is intended to assist users in understanding market conditions, not to direct their actions.

4. Eligibility

To use Hugo's Signals, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement under the laws of your jurisdiction
• Not be located in a jurisdiction where cryptocurrency trading or AI-assisted trading tools are prohibited
• Provide accurate and complete information when creating an account

We reserve the right to refuse service to anyone for any reason, at any time.

5. User Accounts

When you create an account, you agree to:

• Provide accurate, current, and complete registration information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

We are not liable for any loss or damage arising from your failure to secure your account credentials.

6. Plans, Pricing, and Payments

6.1 Free plan

The free plan provides limited access to AI-generated signals at no cost. We reserve the right to modify, limit, or discontinue the free plan at any time without notice.

6.2 Paid plans

Paid plans (Basic, Pro, Premium) require a subscription processed through Stripe. By subscribing, you agree to:

• Pay the applicable subscription fee as displayed at the time of purchase
• Automatic recurring billing at the end of each billing period (monthly)
• Stripe's Terms of Service

6.3 Pricing changes

We may change subscription prices with at least 30 days' written notice (by email). The new price will apply at the start of your next billing period after the notice period. If you do not agree with the price change, you may cancel before it takes effect.

6.4 Cancellation

You may cancel your subscription at any time from your account settings or by contacting us. Upon cancellation:

• You retain access to your paid plan until the end of the current billing period
• Your account reverts to the free plan after the paid period ends
• No partial refunds are issued for unused portions of the billing period

6.5 Right of withdrawal (EU consumers)

Under Spanish and EU consumer law (Real Decreto Legislativo 1/2007), if you are a consumer, you have the right to withdraw from a purchase within 14 calendar days of subscribing, without giving any reason. To exercise this right, contact us at hello@hugobento.com.

If you have actively used the Service during the withdrawal period (e.g., received real-time signals or AI analysis), you acknowledge that the service was partially performed at your request and agree that a proportional amount may be deducted from any refund, in accordance with Article 108 of Real Decreto Legislativo 1/2007.

7. Exchange API Keys and Automated Trading

This section applies only to Premium plan users who choose to connect exchange accounts for automated trading.

7.1 Your responsibility

• You provide your own exchange API keys. We act as a tool executing instructions on your behalf.
• You are solely responsible for configuring your trading parameters (risk tolerance, position sizes, stop-losses).
• You must configure API keys with the minimum necessary permissions (trade-only, no withdrawal access).
• You acknowledge that automated trading carries risk of financial loss, including total loss of invested capital.

7.2 Our limitations

• We do not guarantee the accuracy, timeliness, or profitability of any automated trade.
• We are not responsible for losses caused by exchange downtime, API changes, network issues, or market conditions.
• We are not a broker, custodian, or fund manager. We never hold or have access to your funds.
• Automated trading is provided with a paper trading mode by default. We strongly recommend using paper trading before enabling live execution.

7.3 Security

API keys are encrypted at rest using application-level encryption. Despite our security measures, no system is completely immune to security breaches. You use the automated trading feature at your own risk.

8. AI-Generated Content and Signal Accuracy

• All signals are generated by artificial intelligence models. AI can and does make mistakes.
• Signal accuracy statistics displayed on the platform are historical and are provided for transparency. They do not predict future performance.
• The AI models we use (including models from OpenAI and DeepSeek) may change, improve, or degrade over time. We do not guarantee consistent performance.
• Market conditions can change faster than the signal cadence. A signal that was valid when generated may no longer be valid by the time you see it.
• We do not manipulate, cherry-pick, or selectively display signals. All signals, including incorrect ones, are shown in accuracy tracking.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Resell, redistribute, or republish signals or analysis from the platform without written permission
• Reverse-engineer, decompile, or attempt to extract the source code of the platform
• Use automated tools (scrapers, bots) to access the platform outside of provided APIs
• Attempt to gain unauthorised access to other users' accounts or our infrastructure
• Interfere with or disrupt the integrity or performance of the Service
• Circumvent rate limits, plan restrictions, or access controls
• Create multiple accounts to abuse free tier limitations

Violation of these terms may result in immediate account suspension or termination.

10. Intellectual Property

All content, code, design, and branding of Hugo's Signals is the intellectual property of Hugo Bento unless otherwise stated. This includes but is not limited to:

• Platform source code and architecture
• UI design, layouts, and visual elements
• AI prompt engineering and signal generation methodology
• Marketing materials and written content

You retain ownership of your own data (account settings, trading configurations). We claim no ownership over data you provide.

11. Limitation of Liability

You agree to indemnify and hold harmless Hugo Bento and Hugo's Signals from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your trading activities (whether manual or automated)
• Your violation of any third-party rights
• Any content you submit to the platform

13. Service Availability

• We aim to provide continuous service but do not guarantee 100% uptime.
• The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
• We reserve the right to modify, suspend, or discontinue any feature of the Service at any time.
• For significant changes affecting paid plan features, we will provide reasonable notice.

14. Termination

14.1 By you

You may close your account at any time by contacting us at hello@hugobento.com. Upon closure, we will delete your personal data in accordance with our Privacy Policy, subject to legal retention requirements.

14.2 By us

We may suspend or terminate your account if:

• You violate these Terms
• We are required to do so by law
• We reasonably believe your account is being used for fraud or abuse
• You fail to pay subscription fees when due

Where possible, we will provide notice before termination. In cases of serious violations, we may terminate immediately without notice.

14.3 Effect of termination

Upon termination, your right to use the Service ceases immediately. We will delete stored exchange API keys promptly. Provisions that by their nature should survive termination (including Sections 3, 8, 11, 12, 15, and 16) will survive.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Spain.

For EU consumers: you retain the benefit of any mandatory consumer protection provisions of the law of your country of residence that cannot be overridden by contract.

15.1 Dispute resolution

We encourage you to contact us first at hello@hugobento.com to resolve any dispute informally.

If a dispute cannot be resolved informally, EU consumers may use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

Any legal proceedings shall be brought before the courts of Pontevedra, Spain, except where mandatory consumer protection law requires proceedings in the consumer's place of residence.

16. General Provisions

• Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and Hugo's Signals.
• Severability: if any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
• Waiver: our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Assignment: you may not assign or transfer your rights under these Terms without our written consent. We may assign our rights freely in connection with a merger, acquisition, or sale of assets.
• Language: these Terms are drafted in English. In the event of any conflict between the English version and any translation, the English version prevails.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

• We will update the "Last updated" date at the top of this page
• We will notify registered users by email at least 30 days before material changes take effect
• Continued use of the Service after the effective date constitutes acceptance of the updated Terms
• If you do not agree with the changes, you may close your account before the changes take effect
